1. Agreement to These Terms
Welcome to Rockport Events Calendar. These Terms of Service ("Terms") govern your access to and use of the websites and services we operate, including rockporteventscalendar.com, the Rockport Tickets platform at tickets.rockporteventscalendar.com, and all related applications and features (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
The Services are operated by Sonrey, LLC, a Texas limited liability company, doing business as Rockport Events Calendar ("Rockport Events Calendar," "we," "us," or "our").
2. Definitions
- Service or Services: the websites, applications, and related products operated by Rockport Events Calendar.
- Event: any event, performance, gathering, or experience listed on or offered through our Services.
- Host: the organization, business, venue, or person organizing an Event.
- Ticket: a digital pass granting entry to an Event purchased through our Services.
- Attendee: the holder or purchaser of a Ticket.
- User: anyone using our Services, whether as Host, Attendee, or visitor.
- Platform Fee: the per-ticket fee charged by Rockport Events Calendar to Hosts for use of the ticketing services.
3. Eligibility
You must be at least 18 years old to create an account, host an Event, or purchase Tickets. Attendees under 18 may attend Events only if accompanied by an adult or as otherwise permitted by the Host. By using the Services, you represent that you meet these requirements.
4. Accounts
You may need to create an account to host Events or purchase Tickets. You agree to:
- Provide accurate, current, and complete information when registering;
- Keep your password confidential and your account secure;
- Notify us promptly of any unauthorized access; and
- Take responsibility for all activity that occurs under your account.
We may suspend or terminate accounts that violate these Terms or are used for fraudulent activity.
5. Tickets — Purchase, Delivery, and Use
5.1 Purchase
When you purchase a Ticket, you are entering into a transaction with the Host of the corresponding Event. Rockport Events Calendar provides the technology platform that facilitates the transaction. Unless explicitly stated, we are not the seller, organizer, producer, or sponsor of any Event.
5.2 Pricing and Fees
Ticket prices are set by the Host. Service fees, processing fees, and applicable taxes may be added at checkout and will be shown to you before you complete your purchase.
5.3 Payment Processing
All payments are processed by Stripe, Inc., a third-party payment processor. By making a purchase, you agree to be bound by Stripe's terms of service and privacy policy in addition to these Terms. We do not store full payment card information on our systems.
5.4 Delivery
Tickets are delivered electronically by email and may include QR codes for entry. You are responsible for ensuring the email address you provide is correct and that you can display your Tickets at the Event. Lost or undeliverable Tickets can usually be resent — see our Customer Support page.
5.5 Revocable License
A Ticket grants a revocable, personal, non-transferable license to attend the specified Event. Hosts and venue operators reserve the right to deny entry or remove any attendee for violation of Event rules, venue rules, or for safety reasons, without refund.
5.6 No Resale
Tickets may not be resold, transferred, or used for commercial purposes without the express written consent of the Host. Tickets resold in violation of these Terms may be voided without refund.
5.7 Counterfeit and Duplicate Tickets
Each Ticket has a unique code. The first valid scan grants entry. Duplicate or counterfeit Tickets will be denied entry without refund.
6. Refunds, Exchanges, and Event Changes
6.1 All Sales Final
All Ticket sales are final unless the Event is canceled in its entirety by the Host. Refund eligibility, exchange policies, and waitlist procedures are at the discretion of the Host.
6.2 Cancellation by Host
If a Host cancels an Event in full, the Host is responsible for issuing refunds. Rockport Events Calendar will facilitate refund processing through Stripe upon the Host's written instruction. Refunds typically appear on the original payment method within 5 to 10 business days.
6.3 Postponement or Rescheduling
If an Event is rescheduled or relocated, Tickets typically remain valid for the new date or location. If the new arrangement does not work for you, contact the Host directly to request a refund.
6.4 No Refund for No-Show or Personal Circumstance
Tickets are non-refundable if you fail to attend, miss any portion of the Event, or experience personal circumstances that prevent attendance. This includes (without limitation) weather, illness, transportation issues, and scheduling conflicts, unless the Event itself is canceled.
6.5 Force Majeure
Neither Rockport Events Calendar nor any Host is liable for failure to perform due to causes outside of their reasonable control, including (without limitation) acts of God, severe weather, government action, civil unrest, pandemics, utility failures, terrorism, or natural disasters.
7. Hosting Events
If you are a Host using the Rockport Tickets platform to sell Tickets, you agree to:
- Provide accurate Event information including date, time, location, and description;
- Deliver the Event substantially as advertised;
- Comply with all applicable laws, regulations, and venue rules;
- Maintain appropriate insurance for your Event;
- Respond promptly to Attendee inquiries and refund requests;
- Comply with all Stripe Connected Account terms and any host-specific agreements with us.
Hosts are independent of Rockport Events Calendar. The relationship between Host and Attendee is direct, and Rockport Events Calendar is not a party to that relationship except in our role as a technology platform.
8. Platform Fees
Rockport Events Calendar may charge Hosts a per-ticket platform fee, which is set per Event and disclosed in the host dashboard. Stripe processing fees apply separately and are deducted by Stripe from each transaction. Platform fees are non-refundable except where required by law.
9. Hosts as Merchant of Record
For Ticket sales using Stripe Connect, Hosts are generally the merchant of record for the transaction, and Ticket revenue is paid directly to the Host's connected Stripe account, less applicable fees. Rockport Events Calendar is not liable for any debts, refund obligations, or other obligations of the Host beyond the platform fees paid to us.
10. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose;
- Resell Tickets in violation of Section 5.6;
- Use bots, scrapers, or automated tools to purchase Tickets or access the Services;
- Impersonate any person or entity, or misrepresent your identity;
- Upload malicious code or attempt to disrupt the Services;
- Harass, threaten, or harm other Users;
- Circumvent any security features or access controls.
11. Intellectual Property
The Services, including all text, graphics, logos, code, and design elements, are owned by Rockport Events Calendar and protected by intellectual property law. You may not copy, distribute, modify, or create derivative works without our written permission.
User-generated content (such as Event listings, photos, and descriptions) remains the property of the Host or contributor. By submitting it to our Services, you grant Rockport Events Calendar a worldwide, royalty-free license to display, distribute, and promote it in connection with our Services.
12. Privacy
Use of the Services is subject to our Privacy Policy, which describes how we collect, use, and share information. By using the Services, you consent to the practices described there.
13. Photography and Recording at Events
By attending an Event, you may be photographed, filmed, or recorded by the Host, sponsors, or other Attendees, and your image or likeness may be used for promotional or editorial purposes. If you do not consent to this, please do not attend.
14. Disclaimers
THE SERVICES, EVENT LISTINGS, TICKETS, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Rockport Events Calendar does not warrant that the Services will be uninterrupted, error-free, or secure. We do not warrant the accuracy of Event information, which is provided by Hosts.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ROCKPORT EVENTS CALENDAR'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
IN NO EVENT WILL ROCKPORT EVENTS CALENDAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
16. Indemnification
You agree to defend, indemnify, and hold harmless Rockport Events Calendar, its officers, directors, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any Event you host, attend, or promote through the Services.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. You and Rockport Events Calendar agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Aransas County, Texas, and you consent to personal jurisdiction in those courts.
18. Changes to These Terms
We may update these Terms at any time. Updated Terms will be posted on the Services with a new "Last Updated" date. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
19. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, the sections of these Terms intended to survive (including intellectual property, indemnity, limitation of liability, and dispute resolution) will continue in effect.
20. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
21. Entire Agreement
These Terms, together with the Privacy Policy and any host-specific agreement, constitute the entire agreement between you and Rockport Events Calendar regarding the Services.
